Ordinance No. 69 of 13 September 2006 (the
“GEO”) with regard to the amendment and completion of the Law No.
19 of 17 March 2000 on the public pension and other social insurance
rights (the “Public Pensions Law”)
The GEO further amends
and complete the Public Pensions Law in certain directions pertaining
to the payment and quantum of the pensions.

2006 (the “Law”) concerning the organization and operation of the
National Agency for Employment (the
“NAE”)
The Law aims to regulate
the legal framework pertaining to the NAE.

Law No. 200 of 22
May 2006 (the Law”) regarding the setting up and utilization of the
Fund to guarantee the payment of the wage receivables.
The Law provides for
the incorporation and operation of the Fund in order to guarantee the
payment of the outstanding wage receivables resulting from individual
labour agreements between employees and employers against whom final
and binding court sentences regarding the insolvency procedure have
been pronounced and whose administration rights have been partially
or fully abridged.

2006 (the “Law”) on the national system for social assistance.
The Law establishes the
legal framework in the field of national social assistance.

Law No. 44 of 8 March
2006 (the “Law”) regarding the amendment and completion of the Law
19 of 17 March 2000 on public pensions and other social insurance rights.
The Law provides some
further amendments to the Law 19 of 17 March 2000 regarding the quantum
of the fines applicable in the case of infringements of the above mentioned
law as well as to the written requests related to any documents provided
by the said law in order to proof the seniority in work.
The Law enters into force
in three days as of its publication in the Official Gazette of Romania.

Methodological Norms
of 22 December 2005 for the enforcement of the provisions of the Law

Government Decision No. 1766 of 22 December 2005 regarding the establishment of the minimum gross salary in Romania.
The Government Decision provides for the amount of 330 RON as the minimum gross salary in Romania commencing 1 January 2006.

Government Emergency Ordinance No. 130 of 22 September 2005 (the “GEO”) regarding the amendment and completion of the Law No. 203 of 28 December 1999 on work permits.
According to the provisions of the GEO, the work permit may be issued, upon request, to foreigners that comply to the legal requirements applicable to employment and who hold a valid resident visa for the purpose of employment.

Government Emergency Ordinance No. 65 of 29 June 2005 (the “GEO”) regarding the amendment of the Law No. 53 of 24 January 2003 (the “Labor Code”).
The main amendment to the Labor Code brought by the GEO refers to the working time duration, annual vacation, the labor contract for a determined period of time, the training sessions and the duty of loyalty.

Law No. 141 of 17 May 2005 (the “Law”) on the suspension of application of the provisions of the Law No 249 of 9 June 2004 on the occupational pensions (the “Occupational Pensions Law”).
According to the stipulations of the Law, the applicability of the Occupational Pensions Law is suspended until 1 July 2005.

National Collective Labor Agreement No. 20.01 of 31 January 2005 for 2005 – 2006 (the “NCLA”).
The NCLA shall be concluded for two years, as compared with the previous NCLA which has been concluded for one year. The NCLA provides, amongst others, for the laying-off procedure, the national minimum gross wage and the overtime work).

Government Emergency Ordinance No. 4 of 3 February 2005 (the GEO”) regarding the recalculation of pensions from the public system, coming from the former state social securities system.
The GEO provides for the recalculation of the pensions in the public system, coming from the former state social securities system, established based on the legislation in force prior to 1 April 2001. The recalculation is performed by determining the annual average points and of the quantum of each pensions, subject to the stipulations provided by the Law 19 of 17 March 2000 on public system of pensions and other social securities rights.

Government Decision No. 2346 of 14 December 2004 for the establishment of the gross minimum salary in Romania.
The Government Decision addresses to the regulation of the establishment of the minimum guaranteed basic salary in Romania. Therefore, as of 1 January 2005, for full time working hours of 171,333 hours average/month, the guaranteed gross minimum salary in Romania is established to the amount of ROL 3,100,000 (RON 310).
