The Law provides for
the legal regime of the documents in electronic form containing data
on the economic operations of transfers or selling of goods or services
between persons that issue and receive invoices or other fiscal documents
in an electronic form.

Ordinance No. 3 of 9 February 2006 (the
“GEO”) regarding the amendment of the Law No. 504 of 11 July 2002
on audio-visual (the “Audio-Visual Law”
The GEO further amends
the paragraph 2 of the Article No.75 of the Audio-Visual Law by stipulating
that the retransmission on the Romanian territory of programs services,
broadcasted by radio distributors whom are under the jurisdiction of
the European Union Members is free and does not require any previous
authorization.

Decision No. 686 of 13 December 2005 (the "Decision") of the President of the General Inspectorate for Communication and Information Technology (the "GICIT") regarding the approval of the Tariff Procedure and Listing comprising the tariffs for the utilization of the radio specter, annually due to the GICIT.

Order No. 410 of 3 November 2005 (the “Order”) of the Ministry of Communication and Information Technology pertaining to the experimentation of the Personal Handyphone System (PHS) electronic communication technology.

Decision No. 590 of 25 October 2005 (the “Decision”) of the President of the General Inspectorate for Communication and Information Technology (the “GICIT) regarding the establishment of the term for setting the electronic communication network in radio frequency of 3410-3600 MHz.
The Decision applies to all the license holders entitled to use the radio electric frequencies granted in the radio frequency of 3410-3600 MHz. In six month of the entering into force of the present Decision the license holders must set up the electronic communication network according to the minimal cover requirements and based on the notification related procedures provided by the licenses. Should the license holders will not comply with the above mentioned requirements, the GICIT will withdraw all the holders’ licenses until the latter proves the fulfillment of the afore mentioned requirements.

Government Emergency Ordinance No. 123 of 1 September 2005 (the “GEO”) for amendment and completion of Law No. 8 of 14 March 1996 on authorship rights and other related rights.
The GEO amendments address to the implementation of certain EU directives in the field of (i) protection of software programs, (ii) satellite broadcasting and retransmission through cable and (iii) legal protection of the databases.
