Law 28 of 15 January
2007 (the “Law”) regarding the modification and completion of the
Law No. 64 of 11 October 1991 on patents (the
“Patent’s Law”).
The Law further provides
for several amendments to the Patent’s Law.
The Law enters into force
in three months as of its publications in the Official Gazette of Romania.

Norm of 10 January
2007 (the “Norm”) regarding the enforcement of the Law No. 16 of
6 March 1995 (the “Law”) on the protection of the topography of
semiconductor products.

Decision No. 59 of
27 March 2006 (the “Decision”) of the President of the Romanian
Copyright Office concerning the set out of the conditions for authorization
of the commercial entities bound to request the registration in the
National Registry of the multipliers of CD, audio and video cassettes
(the “NRM”).
The Decision provides
for the establishment of the legal framework related to the authorization
conditions and registration in the NRM of the commercial entities which
develop multiplication activities of the phonograms, videograms, computer
programs inserted on CD, audio cassettes and video cassettes, as the
case may be..

Protocol of 19 December
2005 (the “Protocol”) of the Romanian Copyright Office
regarding the public communication of phonograms published for commercial
purposes or of its copies, as well as the artistic carry outs in the
audio-visual field and the annex comprising the patrimonial rights of
due to the artistic interpreters, executants or phonograms producers.
The Protocol establishes
the legal framework related to (i) public communication of the phonograms
published for commercial purposes, (ii) use of artistic representations
in the audio-visual field for ambient purposes, (iii) phonogram user,
(iv) the user of the artistic representations, and (v) remunerations
related thereof.

The Law No. 337 of 5 December 2005 (the "Law") regarding the modification and completion of the Law No. 16 of 6 March 1995 on the protection of the integrated circuits topography.
The Law provides for some amendments to the Law No. 16 of 6 March 1995 in various aspects related to the protection of the integrated circuits topography.

Protocol of 28 November 2005 of the Romanian Copyright Office regarding the methodology with respect to the remuneration of the intellectual property rights pertaining to the audio visual registration of the music compositions on different formats (the "Protocol").
The Protocol aims to regulate the legal framework with respect to the remuneration of the intellectual property rights pertaining to the audio visual registration of the music composition on different formats.

Law No. 337 of 29 November 2005 (the "Law") regarding the amendment and completion to the Law No. 16 of 6 March 1995 regarding the legal protection of the topography of integrated circuits.
The Law introduces certain amendments with respect to the legal protection of the topography of integrated circuits.

Decision No. 604 of 1 November 2005 of the National Audio-Visual Council (the "Decision") for the amendment of the Decision No. 254 of 5 July 2004 regarding the publicity, sponsorship and TV shopping.
The amendment brought by the Decision pertains to the information presented by the publicity sponsorship and TV shopping, which must not mislead the audience with respect to the prices or taxes. The latter have to be fully disclosed.

Decision No. 555 of 11 October 2005 of the National Audio-Visual Council (the "Decision") for the amendment and completion of the Decision No. 254 of 5 July 2004 regarding the publicity, sponsorship and TV shopping.
The main amendments and completions brought by the Decision refer to (i) information or warnings displayed in videotext format, (ii) broadcasting of announcement of public interest for charitable purposes, (iii) advertising of pharmaceutical products, (iv) promotion of feeding supplements, nutritive supplements, vitamins and nutrients, and (v) participation and interventions of lawyers in broadcasted shows in which pending court cases are debated.

Law No. 280 of 5 October 2005 (the "Law") for the approval of the Government Emergency Ordinance No. 100 of 14 July 2005 (the "GEO") on ensuring the rights of industrial property.
The Law approves the GEO and further provides for the meaning of the wording "industrial property rights" as well as certain legal procedures in terms of litigation involving the industrial property rights.

Government Emergency Ordinance No. 123 of 1 September 2005 (the "GEO") for amendment and completion of Law No. 8 of 14 March 1996 on authorship rights and other related rights.
The GEO amendments address to the implementation of certain EU directives in the field of (i) protection of software programs, (ii) intellectual property, (iii) authorship rights regarding satellite broadcasting and retransmission through cable, (iv) protection duration of the authorship rights, (v) legal protection of the databases, (vi) authorship rights related to the informational society, (vii) droit de suite for the benefit of author of an original work of art and (viii) measures for insuring the intellectual property rights.
