Government Emergency
Ordinance No. 12 of 28 February 2007 (the
“GEO”) on the amendment and completion of certain enactments related
to the enforcement of the acquis comunitari in the environmental
field.
The GEO provides for
several amendments to certain enactments regarding of the enforcement
of acquis comunitari in the environmental field.
The GEO enters into force
as of its publication in the Official Gazette of Romania. (Official

Law 84 of 5 April
2006 (the “Law”) for the approval of the Government Emergency Ordinance
No. 152 of 10 November 2005 (the “GEO”) on the prevention and integrated
control of the pollution.
The Law approves and
amends the GEO in certain aspects.

in three days as of its publication in the Official Gazette of Romania.

Order No. 117 of 2
February 2006 of the Ministry of Environment and Water Management
(the “Order”) regarding the approval of the Manual pertaining to
the enforcement of the environmental evaluation procedure for plans
and programs.
The Order approves the
Manual for the enforcement of the environmental evaluation procedure
for plans and programs. According to the provisions of the said Order,
the Manual is utilized by the relevant environmental authorities as
well as other entities qualified for drafting plans and programs in
the process of implementation of the environmental evaluation procedure
for plans and programs.
The Order enters into

Methodological Norms
of 4 January 2006 of the Ministry of Environment and Water Management
regarding the emplacement permits.
The Methodological Norms
provides for the emplacement permits required should the economical
or social objective is placed in the easily flooded river bed or in
the protection zones stipulated in the Law 107 of 25 September 1996
on water.
The Methodological Norms
enter into force as of its publication in the Official Gazette of Romania.

The Procedure of 23
December 2005 of the Ministry of Environment and Water Management
(the Procedure) regarding the survey of the
objectives that presents the risk of major accident involving dangerous
substances.
The Procedure aims to
establish a survey framework of the objectives that presents certain
risks of major accidents involving dangerous substances. The main goal
of the survey is to systematically examine the technical equipments,
the organization and administration of the objective in order to determine
if the activity holder has taken all the necessary measures to guarantee
a high level of protection for people, assets and environment.
The Procedure enters
into force as of its publication in the Official Gazette of Romania.

Government Emergency
Ordinance No. 196 of 22 December 2005 (the
“GEO”) regarding the environmental fund.
The GEO regulates the
legal framework of the environmental fund, viewed as an economical and
financial instrument for the supporting and accomplishment of the projects
related to the environmental protection.
The GEO enters into force
as of its publication in the Official Gazette of Romania. (Official

“GEO”) regarding the environmental protection.
The GEO aims to establish
the legal framework related to the environmental protection. According
to the provisions of the GEO, the environmental protection is viewed
as an objective of public interest.
